We at Techtronic Industries Canada, Inc. and TTI Consumer Power Tools, Inc. (“CPT,” “Ryobi,” or “we”) respect your privacy, which is why we have put this privacy policy (this “Privacy Policy” or “Policy”) in place. This policy describes the types of Personal Information we may collect from you or that you may provide to us, and our practices for collecting, using, maintaining, protecting and disclosing that Personal Information.

What is Personal Information?

In this Policy, the term Personal Information refers to all information about an individual that allows them to be identified alone or in combination with other information, for example, their name, contact information, birth date, credit card number, etc. Personal Information can also refer to more technical information, such as an IP address, web browser settings and a device’s unique ID, but only when this information identifies you as an individual. Information that is rendered anonymous and cannot be associated with an individual is not considered personal Information.

Scope and application

This policy applies to Personal Information we collect: (1) when you visit www.ryobitools.ca (our “Website”); (2) when you install, access, or use our mobile or desktop applications you may download from the Website, or apps provided by or on behalf of CPT through an online app store or other comparable mechanism (collectively the “Apps” and, together with the Website, the “Services”), including all information entered or collected by or in connection with the Apps; (3) when we communicate with you via e-mail, text, chat, or any other electronic means of communication; and/or (4) when you purchase products from us.

This Policy also covers our use of cookies and tracking technology such as pixels and beacons (together, “Cookies”). For the purposes of this Privacy Policy, we consider your cookies to be Personal Information. We address our use of Cookies and how you can control our use of them further below.

This policy does not apply to workforce-related Personal Information collected from employees, job applicants, contractors, or similar individuals, whose information is subject to internal policies.

Links to Third-Party Websites found on our Services

This Policy does not apply to third party websites. Our Services may include links to third-party websites as well as content and applications hosted and served by third parties. Clicking on those links may allow the third-party to collect or share Personal Information about you. If you follow a link to a third-party website, please refer to the third-party’s privacy policy for information on the type of Personal Information it collects, and how it uses or discloses it. We do not endorse and are not responsible for the information or privacy practices of websites or services owned by third parties. CPT is therefore not responsible for the privacy policies, procedures or practices of third parties.

Children Under the Age of 14

The Services are not intended for children under 14 years of age. No one under age 14 may use the Services, or provide any Personal Information to or on the Services. We do not knowingly collect Personal Information from children under 14. If you are under 14, do not use the Services or provide any information to us. If we learn we have collected or received Personal Information from a child under 14 without verification of parental consent, we will delete that information. Personal information We Collect About You and How We Collect It

We collect several types of Personal Information from or about users of the Services, including:

Information that identifies you directly or with which you can be contacted, such as, for example, your name, postal address, email address, or telephone number.

Information that is about you or associated with you, such as, for example, geolocation information (e.g., we use geolocation to provide you with the ability to locate your tools, if you have enabled that service or general location information that we receive from your mobile device or computer).

Automatic Information Collection and Tracking

As you access or use the Services, we may use automatic data collection technologies to collect certain Personal Information, which may include:

The technologies we use for automatic information collection may include:

Cookies. A cookie is a small file placed on your device. Pixels. A tracking pixel, also known as a marketing pixel, is a pixel graphic used to track user behavior, site conversions, web traffic, and other metrics similar to a cookie. It may be used for targeting or retargeting purposes.

When you navigate to our Websites, tracking technologies such as Google Analytics use cookies and other, similar technologies, to collect information about how users use the website. The information generated by the cookie about your use of the Website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of our website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. We retain the information we collect only as long as is reasonably necessary for the purposes described in this Policy, or for business purposes (for instance, to fulfill our contractual obligations, or protect or enforce our legal rights) or as otherwise permitted by law.

We do not control third parties’ collection or use of your Personal Information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your Personal Information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

As mentioned at the top of this Policy, even after you have consented, you retain the right to withdraw your consent to the collection, use or disclosure of Personal Information at any time. To withdraw your consent, please contact our Privacy Officer at [email protected]. We may not accommodate a request if we believe the change would violate any law or legal requirement. If we cannot accommodate a request, we will provide you with a justification. Please note that if you withdraw your consent we may not be able to provide you with a particular service.

Data Security and Accuracy of your Personal Information

We make reasonable efforts to protect Personal Information and have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. We protect Personal Information in a manner appropriate for the sensitivity of the Personal Information. For instance, we use technical safeguards such as encryption, firewalls, anti-virus, system monitoring; administrative and organizational safeguards such as internal policies and training of employees on privacy and information security, access controls and ensuring individuals get access to Personal Information on a “need to know” basis, or contractual assurances with service providers.

The safety and security of your Personal Information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Services, you are responsible for keeping this password and any other account credentials confidential. We ask you not to share your credentials with anyone. We urge you to be careful about giving out Personal Information in public areas or elements of the Services like message boards. The Personal Information you share in public areas may be viewed by any user of the Services.

Unfortunately, the transmission of Personal Information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to or via the Services. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained in the Services.

We make reasonable effort to ensure that Personal Information is accurate and complete. We rely on individuals to notify us if there is a change to their Personal Information that may affect their relationship with our organization. Data Transfers across Borders

Personal Information that we collect may be stored and processed in Canada (including parts of Canada outside Quebec) and any other country in which we or our service providers maintain facilities, including the United States.

Personal Information processed and stored in another country jurisdiction may be subject to disclosure or access requests by the governments, courts or law enforcement or regulatory agencies in that country according to its laws of general application, including data protection laws.

If your Personal Information is transferred outside of your jurisdiction, we will take steps to ensure your Personal Information is adequately protected notably by including contractual measures to ensure the protections in place for your Personal Information are at least equivalent to those employed in Quebec and throughout Canada.

Your Rights

Accessing and Correcting Your Information

You can review and change your Personal Information by logging into the Services on the applicable Website and visiting your account profile page(s).

You may also send us an email at [email protected] to request access to, correct or delete any Personal Information that you have provided to us. We may require that you provide some information to validate your identity prior to fulfilling your request. We cannot delete your Personal Information except by also deleting your user account. We may not delete your Personal Information if retention is required for ongoing transactions with you or otherwise for our legitimate business purposes consistent with this policy or as permitted by law. We may not accommodate a request to change Personal Information if we believe the change would violate any law or legal requirement or cause the Personal Information to be incorrect.

Unless doing so raises serious practical difficulties, residents of Quebec have the right to have computerized Personal Information that was directly collected from them communicated, at their request, to any person or body authorized by law to collect such information.

Changes to Our Privacy Policy

We reserve the right to update our Privacy Policy from time to time. This Policy is effective as of the date noted above and supersedes previous versions. You are responsible for periodically visiting this Privacy Policy to check for any changes. Your continued use of our Services following the posting of changes constitutes your acceptance of such changes.
